1. Background/Introduction 

1.1 The purpose of this Policy is to provide clear guidelines on Fastmount Ltd’s (“Fastmount”. “we”, “our” or us”) collection, use, storage and disclosure of personal information, and our support of relevant agencies and how we assist investigations of suspected breaches of this privacy policy. This privacy policy also describes our commitment to the privacy of you and our users of our website and compliance with the New Zealand Privacy Act 2020 (“the Act”) and other data privacy laws and regulations which may be applicable to our websites and you. The Policy is subject to and part of the Fastmount Terms of Use. Any terms defined in the Terms of Use have the same meaning as set forth below.

1.2 This privacy policy applies to information we collect from or about you:

  • On or in connection with the website, including establishment of an account with us.
  • In email, text, and other electronic messages between you and the website.
  • When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

1.3 The Policy also provides information about:

(a) the methods used by Fastmount designed for the protection for personal information held by Fastmount
(b) how to seek assistance if you experience any data privacy incidents on or in connection with this website; and
(c) how you can access and correct any personal information that we hold about you;

(d) how to request information from us; and

(e) where applicable, Fastmount’s compliance with the Act and other data privacy laws, if and where applicable to you.

If you do not agree with our policies and practices, your choice is not to use our website or services. By accessing or using this website, you agree to this privacy policy. This privacy policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the website after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

2. Application of this Policy

2.1 The application of these policies is as follows:

(a) To the greatest extent permitted at law, New Zealand law applies to the relationship between Fastmount and its customers and users with respect to the website, establishing an account and matters covered by this privacy policy.

3. What is personal information?

3.1 The term “personal information” has the meaning given to it in the Act or the data privacy legislation that is applicable to you or your use of our website and services. In general, personal information is any information that can be used to personally identify you. This may include such information or items as your name, address, telephone number, email address and profession or occupation or a combination thereof.

3.2 A “Cookie” is file which allows us to track your likes, dislikes and interests as you use our websites. A Cookie will not identify you, it will simply assist us in customizing your experience on or with our website and services.

3.3 Where appropriate, we will seek information from you directly in the first instance and/or verify information received from third parties with you before relying on it.

4. Collection of your information

4.1 Personal information will be collected only for a lawful purpose connected with and necessary for a Fastmount activity as described further in this privacy policy.

4.2 We collect several types of information from and about users of our Website, including information:

  • By which you may be personally identified, such as name, postal address, email address, telephone number, any other identifier by which you may be contacted online or offline (“personal information”);
  • That is about you but individually does not identify you, such as age, gender, location; and/or
  • About your internet connection, the equipment you use to access our Website, and usage details.

We collect this information:

  • Directly from you when you provide it to us.
  • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.

4.3. Information You Provide to Us 

The information we collect on or through our Website may include:

  • Information that you provide by filling in forms on our Website. This includes information provided at the time of registering to use our Website or requesting further services. We may also ask you for information when you report a problem with our Website.
  • Records and copies of your correspondence (including email addresses), if you contact us.
  • Details of transactions you carry out through our Website and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Website.

4.4. Information We Collect Through Automatic Data Collection Technologies

Pages of our Website [and our emails] may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or [opened an email] and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

4.5 Fastmount uses Google Analytics (which collects your browser identifying information when visiting Fastmount site) to see page views and browsing activity on Fastmount’s website. This is used for the purpose of improving the usability of our website.

4.6 Fastmount uses Facebook (which collects browser identifying information when visiting the Fastmount website) for more targeted advertising.

4.7 You are free to consent or withdraw consent from this tracking on Fastmount.

Google and Facebook can not supply your name/email/phone details to us and we do not supply your personal details to Google or Facebook

4.8 Our Website is not intended for children under 16 years of age. No one under age 16 may provide any personal information to or on the Website. We do not knowingly collect personal information from children under 16. If you are under 16, do not use or provide any information on this Website or through any of its features, register on the Website, make any purchases through the Website, use any of the interactive or public comment features of this Website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 16, please contact us at support@fastmount.com.

5. How we use and store your information

5.1 We use your personal information to fulfil contracts with you, to contact you about your account, to provide maintenance and support, to process and address payment matters, to improve our customer service, to meet our legal obligations and to detect and prevent security breaches or fraud. We use additional information to do internal research on our users’ demographics, interests, and behaviour to better understand and serve you and our markets.

5.2 We store your IP address on our web servers and backups for the purpose of fraud prevention and system debugging.

5.3 We store your personal details from requests for CAD files, samples and technical advice on our email and we may send these details to your nearest Fastmount distributor in order to fulfil your request. These distributors may be in the same country as you or a different country.

5.4 We store personal information relating to product orders on our CRM system and backups for the purpose of fulfilling customer orders.

5.5 We store personal information from subscriptions to our newsletters and product updates on Hubspot.

5.6 Information collected by Google and Facebook is stored by them and used for marketing and retargeted advertising.

5.7 Fastmount does not sell or rent your personal information to third parties.

5.8 We release account and other personal information only when we believe release is appropriate to comply with law, enforce or apply our terms and conditions, fulfill and support orders for products, or protect the rights, property, or safety of Fastmount or others.

5.9 We use security measures, including data encryption, password protected authentication and physical access controls which are designed to protect your personal information from loss and unauthorised access when your personal information is retained or stored by us.

5.10 If you place an order by logging into our website, it is your sole responsibility to protect your password and access credentials, and important for you to protect against unauthorised access to your personal information and account by ensuring that you, among other criteria, log out of your account when you have finished visiting or accessing Fastmount and by keeping your password secret from others, and updating it from time to time, particularly when your autnorised users no longer work with you or are part of your organisation.

6. How long we store your information

6.1 In order to protect our IP rights we retain some personal information for up to 20 years. This applies to contact information relating to product purchase, enquiries and sales.

6.2 We delete other sources of information as follow:

(a) Database backups: after 60 days

(b) Web server logs: after 30 days

(c) Google Analytics : 25 months

(d) System logs: 180 days

7. Your rights to access and correct your information

7.1 You can ask us to provide you with information we hold about you and request corrections to it at any time. There may be a charge for providing this information, but we will let you know if this is the case before we provide you the information.

7.2 Fastmount will take all reasonable steps to ensure that the information it holds is accurate, up to date, complete and not misleading.

7.3 Fastmount will ask you to reconfirm your details from time to time to ensure ongoing consent to the its use of your personal information.

7.4 You can unsubscribe from our marketing database by clicking on the link in any marketing email that you receive from us.

8. Disclosure of your information

8.1 Fastmount will generally only disclose your personal information in circumstances where it is being disclosed for the purposes it was collected, or you have authorized the disclosure. There may be some circumstances (eg. to lessen a threat to public or individual health and safety or to assist with law enforcement) where we may also disclose information. Where reasonably practicable and where applicable, information disclosed will be anonymous.

9. Cookies

9.1 Our site is able to place a Cookie on your computer or IT system.

9.2 We may use this information to help us identify you, to personalize your experience when you visit our site and to provide you advertisements for our services when you visit ours or third party websites.

9.3 You can stop Cookies being placed on your computer or IT system by changing the settings for your internet browser. Please note that some of our website’s features will not work without Cookies.

9.4 In addition, our website may use a third party Cookie such as Google Analytics for display advertisers, including the following features:

(a) Google display network impression reporting – this gives us additional insight as to who has viewed our paid advertising on other websites. This will help us optimise and tailor our advertising.

(b) DoubleClick Platform integrations & Remarketing with Google Analytics – the integrations between both our web analytic and paid advertising platforms together to give us additional insight. This allows us to tailor our advertising to ensure the right types and offers are shown to you while you are using the internet outside our website.

(c) Google Analytics Demographics and Interest Reporting – which gives us insight into behaviour information relating to visitor age, gender and organisation type and industry.

(d) Interests on an anonymous and aggregate level. This will help us to understand browsing behaviour to give you a better experience whilst visiting our website.

(e) Cookies are used to analyse your use of our website and to serve ads when you visit our website. The information we collect and share with third parties through cookies is aggregated and therefore anonymous (it does not include personal information which is likely to identify you). The information may be used to serve you ads in relation to our products when you visit our website and third party websites. You can access information about Google’s Privacy Policy here .

(f) While we recommend that users enable cookies on their browsers in order to enjoy all the features of our website, the decision remains in the hands of you, the user. Most browsers allow you to control management of cookies, this will be different depending on each user’s PC – refer to your browser help menu for further information.

10. Third Party, Internet and Advertising Links

10.1 Some Fastmount advertisers may request information directly from users, or link to sites that do so. We have no control over our advertisers’ privacy policies, and encourages users to review such policies prior to submitting any personal information to them.

10.2 Fastmount may contain non-advertising links to a variety of third party sites to enhance the customer experience. We have no control of either the content or privacy policies of such sites, nor should such links be considered an endorsement of these sites except where otherwise noted.

10.3 We share information about your use of our website with our social media and advertising service providers, including Facebook, for targeted advertising purposes.

10.4 Fastmount, like most large websites, uses a counting system to collect information, such as the number of visitors per day or the number of pages requested per day. To do this, Fastmount has a small piece of Google code on each page which counts these statistics. This enables us to better understand how our website is used, and how you found our website

11. Complaints

11.1 We take compliance seriously. To report a breach you will need to complete a privacy complaint form, and send it to our privacy officer.

11.2 Any suspected or known breaches of the privacy policy will be investigated by the privacy officer, who, if and where a breach by Fastmount has been determined to have occurred, will take appropriate action designed to prevent any further breach and minimise impact.

11.3 If it is determined that twe have committed a breach of a person’s personal information which has the potential to cause embarrassment or harm, the affected individual will be advised of the breach and we will work, to the extent practicable, to minimise impact.

11.4 Should there be an intentional breach of the privacy of a person by us, the person who is considered to have committed the breach may be deemed to have committed serious misconduct and may be subject to disciplinary procedures up to and including dismissal. They may also be subject to the terms of the Act.

11.5 If you are subject to the Act and New Zealand law. Then you can also make a complaint directly to the Privacy Commissioner. The Commissioner will either investigate the complaint or decide to take no action, following the rules set out in the Act. The privacy officer will assist the Privacy Commissioner in any investigation.

12. Changing this policy

12.1 We may change this policy at any time by changing or removing existing terms or adding new ones. Changes may take the form of a completely new policy. If we make material changes to how we treat our users’ personal information, we will notify you through a notice on this page. The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our website and this privacy policy to check for any changes.

If you reside in the US, the following rights may apply to you and your access and use of the Fastmount website: California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:

  • Confirm whether we process their personal information.
  • Access and delete certain personal information.
  • Correct inaccuracies in their personal information, taking into account the information’s nature processing purpose (excluding Iowa and Utah).
  • Data portability.
  • Opt-out of personal data processing for:
    • targeted advertising (excluding Iowa);
    • sales; or
    • profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah).
  • Either limit (opt-out of) or require consent to process sensitive personal data.

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out rights may submit a request to this designated address: support@fastmount.com. However, please know we do not currently sell data triggering that statute’s opt-out requirements.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. Any payment transactions will be encrypted using SSL technology.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the website like message boards. The information you share in public areas may be viewed by any user of the website.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our website.
